Privacy policy

The practice of Maître Fanny Binard attaches great importance to the protection of your personal data. This policy explains what data is collected, why, and what your rights are, in accordance with the General Data Protection Regulation (GDPR).

Data collected

Via the contact form: your full name, your email address, your telephone number (optional), the subject of your enquiry and the content of your message, as well as any files you choose to send (up to 3 files, 4 MB in total). As these documents may contain sensitive data, please attach only the items genuinely useful to your enquiry. No data is collected without your knowledge.

Purposes and legal basis

Your data is processed solely to respond to your enquiry and, where applicable, to manage your case. The legal basis is your consent and, in the event of a case, the performance of the contract and compliance with the lawyer's legal obligations.

Audience measurement (cookies)

With your consent, this site uses audience-measurement and usage-analysis tools — Google Analytics (audience measurement) and Microsoft Clarity (heatmaps and pseudonymised recording of your browsing — mouse movements, clicks, scrolling; the fields you fill in are masked by default) — to improve the site. None of these tools is activated without your consent. You can change your choice at any time via the ‘Manage cookies’ link at the bottom of the page.

Recipients

Your data is processed by the practice. It is neither sold, rented, nor passed on to third parties for commercial purposes. Technical subcontractors may have access to it strictly to the extent necessary for their task: the site host (Mozzon), the email-delivery provider (SMTP server) that transmits the messages sent via the contact form, and the audience-measurement tools (Google, Microsoft). Each acts under a data-processing agreement compliant with Article 28 GDPR.

Transfers outside the European Union

The audience-measurement tools (Google Analytics — Google Ireland / Google LLC; Microsoft Clarity — Microsoft Corporation) may involve a transfer of your data to the United States. These transfers are framed by the EU–U.S. Data Privacy Framework, to which Google and Microsoft adhere, and, additionally, by the European Commission’s standard contractual clauses. Apart from these tools, your data is processed within the European Union. You may obtain a copy of the safeguards by writing to fanny.binard@avocat.be.

Retention period

Enquiries with no follow-up are kept for a maximum of one year. Data relating to a case is kept for as long as required by the lawyer's legal and ethical obligations, then deleted. Audience-measurement data and cookies (Google Analytics, Microsoft Clarity) are kept for a limited period set in those tools' retention settings (a maximum of 14 months for Google Analytics).

Your rights

You have the right to access, rectify, erase, restrict, object to and port your data. Where processing is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before the withdrawal. To exercise these rights, write to fanny.binard@avocat.be. You may also lodge a complaint with the Data Protection Authority (APD), Rue de la Presse 35, 1000 Brussels — www.autoriteprotectiondonnees.be.
